TERMS AND
CONDITIONS
1.
The
Tenant agrees to rent the property known as “Sandpiper” at Beachwalk Isles,
Fort Myers, Florida from Chris & Lorraine Harding (the Owners). This occupancy
will be in the form of a vacation rental only and will not constitute a
permanent or primary residence.
2.
Occupancy
shall begin no earlier than 4.00 pm and departures will be no later than 11.00
am. It may be possible to arrange a later check-out time but this cannot be
confirmed until two days before departure. The Tenant acknowledges the need to
leave on the date of their departure by no later than 11.00 am. Further, in the
event that the Tenant breaches the agreement and stays past the agreed departure
date or time, then they will be held liable for any expenses caused to a Tenant
waiting to occupy and for any expenses incurred by the owner as a result
(direct or indirect) of their delayed departure.
3.
The
maximum occupancy of “Sandpiper” is 8 (eight) people. In addition, an infant or
child under 10 (ten) can be accommodated, providing a cot or an extra roll-away
bed (at additional cost) is rented at the time of booking.
4.
You will
be required to register with our local Management Company within 24 hours of
arrival (in order for us to comply with Florida Statute to keep guest records)
and, upon check-in, you will be required to leave a credit card imprint as a
security deposit. No money will be taken from this card except to cover the
cost of repairs for any damage or loss caused during your stay. In the event
that any damage or loss is reported or detected, the Management Company will
write to advise you of this and the cost of any repairs.
5.
A deposit
of £150 / $250 / 200 Euros is required for each week or part-week rented.
Payment of the deposit should be made within 7 (seven) days of the provisional
booking in order to confirm the booking. The balance is required 8 (eight)
weeks prior to the occupancy commencing.
6.
Cancellations
must be made in writing at least 8 (eight) weeks prior to the scheduled arrival
date. Cancellations will result in the forfeiture of the deposit. Payment is
due in full for all ‘no-shows’ and rentals cancelled within 8 (eight) weeks of
the proposed occupancy. Tenants are strongly advised to take out relevant
insurance to protect themselves in case of cancellation.
7.
There
shall be no pets allowed on the premises and “Sandpiper” is strictly a
no-smoking home. If residents do smoke in the home they will be responsible for
the cost of ridding the home of smoke and ash residues that have permeated the
furnishings.
8.
The
Management Company must be notified immediately of any fault with the property
or surrounds. Once notified, all reasonable efforts will be made to correct the
problem with all expediency. No claims for compensation of any kind will be
considered unless this procedure is followed. In the unlikely event that a
problem cannot be satisfactorily resolved, the Tenant should obtain an incident
report number from the Management Company which will serve as proof of a
complaint being lodged. Without an incident report number, neither the Owner
nor the Management Company will enter into any further correspondence
concerning a complaint. In the event that agreement concerning compensation
cannot be reached, the laws pertaining to the State of Florida shall apply

Additional
items such as high chairs, cots / rollaway beds can be hired from the
Management Company at check-in or by prior arrangement. Cleaning is done
between lets but extra cleans can be arranged during your stay for an
additional charge if required.
10.
Tenants
are expected to behave with consideration in observing the privacy of neighbors
(many of whom are permanent residents), and to take reasonable precautions in
relation to potential hazards such as the swimming pool by observing basic
health and safety rules during their stay at “Sandpiper”.
11.
The
swimming pool is cleaned weekly and no responsibility can be accepted for dust
or dirt entering the pools between cleans. The pool has an automated cleaning
system and a net and brush are also provided
12. Florida is semi-tropical and insects are a fact of
life. “Sandpiper” is treated regularly with insecticides and the residue of
these treatments may leave some dead insects on the floor between cleans. This
is not a sign of the house being infested but rather that the treatment is
working.
13. We
do not accept any liability for injury, damage or loss caused by any reason or any
claim made as a result of this booking or the subsequent holiday. The client is
responsible for taking out an adequate insurance policy / policies to cover all
risks. This waiver is also applicable to guests of the clients. If a
catastrophe (hurricane, tornado, earth quake, flood etc) impairs our villa, we
the owners are not responsible for finding alternative accommodation for the
rentor or any financial losses related to transportation or alternate lodgings
(force majeur).
14. Clients
should always observe the safety rules listed in the information and safety
book held in the rental home.
15.
If any
clause in these terms and conditions is contrary to law, the remainder shall
remain in full force. The laws of the State of Florida shall apply to all terms
under this agreement.
